Stallion Service Contract
I/We hereby agree to breed my/our mare:

for the 2005 season at a breeding service fee of:
_________________ + GST. Of this amount, a non-refundable Booking Fee of $500.00
is payable with this contract and the board, veterinary services and all other
expenses will be paid when the mare is picked up from the breeding farm. If
transported semen is used, the stud fee as a whole is due and payable when the
semen is shipped. Once viable semen has been shipped to the Mare Owner or
his/her agent, the stud fee is non-refundable.
Mare Care will be charged at the following rates:

- The Mare Owner agrees that the Mare offered for breeding is
in sound breeding condition and free from infection and disease. The
Stallion Owner may have a veterinarian check and treat the mare for any
abnormal breeding condition or disease with the expense charged to the Mare
Owner.
- A current negative culture is required for live-cover
breedings. However when artificial insemination and/or transported semen is
used, a current negative culture is recommended but the decision to culture
a mare or not is left to the discretion of the attending veterinarian. All
inseminations must be performed by a licensed veterinarian.
- In the case of any illness, condition, disease or injury,
the Mare Owner agrees that a suitable course of treatment may be undertaken,
in consultation with the Mare Owner, by a qualified veterinarian at the Mare
Owner’s request.
- Diligent effort will be made to settle the mare, however,
if for any reason she does not settle, the Stallion Owner (or his/her agent)
will not be held liable.
- The Stallion Owner reserves the right to decide the method
by which the mare will be bred. (ie. Live cover or AI using either fresh or
frozen semen). Veterinary costs associated with Artificial Insemination are
to be assumed by the Mare Owner.
- The Stallion Owner guarantees a live foal, defined as one
that stands and nurses the Mare, a substitute mare, or other nursing
apparatus, within 24 hours of birth. If a live foal does not result from
this mating, as evidenced by a veterinary certificate within one week of
foaling, the Mare Owner is entitled to a return privilege in the next
breeding season only, for the same Mare or a substitute approved by the
Stallion Owner. Said veterinary certificate must set forth the events giving
rise to the right to a return breeding and must further certify that the
loss of a live foal was not due to the Mare Owner’s neglect.
- The Mare should have had at least two Equine
Rhinopneumonitis vaccinations during her pregnancy. Any veterinary
certificate submitted to the Stallion Owner must state vaccination dates.
(Ref. #6).
- It is understood that the Stallion Owner, his/her
employees, veterinarians, and agents shall not be liable for any injury,
escape, or death of any horse presented to the Stallion for breeding. The
Mare Owner agrees to hold the Stallion Owner his/her employees,
veterinarians, and agents harmless for any damage or injury to any person,
horse or property caused in whole or in part directly or indirectly by the
Mare Owner’s Mare and/or her foal.
- It is agreed that if the mare dies or becomes unfit for
breeding during the breeding season, the Mare Owner may substitute another
mare to breed to the Stallion; subject to the breeding requirements and
approval of the Stallion Owner. (Ref. #6).
- If the Mare is sold or this breeding is not used by the
Mare Owner within the current year and/or the next year’s breeding season,
this contract is non-transferable.
- The Stallion Owner agrees that if the Stallion or Mare dies
or becomes unfit for service during the current breeding season prior to
breeding the mare, or shipment of semen, then the stud fee and any deposit
paid will be refunded. This contract shall then become null and void. Should
the Stallion die or become unfit for service during the life of this
contract, and frozen semen is available to fulfill the Stallion Owner’s
obligations under the terms of this contract, then the Mare Owner will be
shipped frozen semen to a maximum of six (6) doses.
- If frozen semen is used exclusively, it will be shipped to
the Mare Owner three (2.5 ml.) or fifteen (.5 ml.) straws at a time to a
total annually of six (2.5 ml.) or thirty (.5 ml.) straws in order to
achieve one pregnancy in the mare named in this contract.
- When frozen semen is shipped, any unused straws remain the
property of the stallion owner. It is the obligation of the Mare Owner to
inform the Stallion Owner of the existence of any such surplus straws once a
pregnancy has been achieved in the above named mare.
- A deposit of $250 is required for the shipping container
prior to the first shipment of semen. These funds will also be used, in
whole or in part, to cover the cost of shipping semen to the Mare Owner. Any
residual funds will be returned to the Mare Owner following the final
shipment of semen.
- It is understood that the Mare Owner agrees to return the
shipping container in usable condition to Camelot Stables within 48 hours of
receipt of the shipment of semen.
- When two copies of this contract are signed by both
parties, it will then be a binding contract on both parties, subject to the
above terms and conditions.
- For the purposes of this contract, all funds contained
herein are Canadian dollars.
